2. SMS Program Terms — NonProfit CEO Alerts

Program Name and Description

NonProfit CEO offers an SMS messaging program called "NonProfit CEO Alerts" (the "SMS Program"). By opting in to the SMS Program, you agree to receive text messages from us related to your use of the Service, including account and service notifications, reminders, customer support messages, and marketing or promotional messages about our products, services, special offers, trainings, and events. Message frequency varies.

Opt-Out Instructions

You can cancel the SMS service at any time. Simply text "STOP" to the number that you receive messages from (for example, +1 228-400-8807). Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us through the SMS Program.

Rejoining Instructions

To rejoin the SMS Program after you have opted out, you may sign up again through any of our online forms or other opt-in methods as you did initially. Once you complete the opt-in process again, we will resume sending SMS messages to you.

Legal Compliance Note

By participating in the SMS Program, you represent that you are the owner or authorized user of the mobile device and number you provided and that you are at least 18 years of age. You agree that your participation in the SMS Program is subject to all applicable laws and regulations, including, where applicable, the Telephone Consumer Protection Act (TCPA) and other federal, state, and local laws governing text messaging and marketing communications.

3. Communications

By creating an Account on our Service, you agree that we may send you communications related to the Service, including administrative messages, account notices, and transactional information. You may also receive newsletters and marketing or promotional materials from us.

You may opt out of marketing and promotional email communications at any time by following the unsubscribe link or instructions provided in any email we send. Opting out of email marketing does not affect your receipt of transactional or account-related communications.

5. Contests, Sweepstakes, and Promotions

Any contests, sweepstakes, or other promotions (collectively, "Promotions") made available through the Service may be governed by rules that are separate from these Terms & Conditions. If the rules for a Promotion conflict with these Terms and Conditions, the Promotion rules will apply.

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

You agree to defend, indemnify, and hold harmless NonProfit CEO and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

  • your violation of any third-party right, including without limitation any privacy or intellectual property right.
